New York Attorney General Letitia James was indicted on charges related to mortgage fraud on Thursday, shortly after MSNBC reported that Lindsey Halligan, the U.S. attorney for the Eastern District of Virginia, presented evidence against James to a grand jury.
Halligan, who was appointed to her post last month after her predecessor stepped down after refusing to prosecute James, recently secured an indictment against another longtime foe of President Donald Trump, former FBI Director James Comey.
Trump gave Halligan her job in September after Erik Siebert, another Trump appointee, resigned from his position.
According to CNN’s Evan Pérez, it is unusual for a U.S. Attorney to present the evidence against the target of an investigation themselves. After Comey’s indictment, he said the following on air:
Yeah, no, the bare bones nature of this charge, of this indictment really stands out. And what we know about it, Kaitlan, is that Lindsay Halligan, who is the newly installed U.S. Attorney in the Eastern District of Virginia, she is the one who personally presented this to the grand jury
That’s not normal. Usually you have career assistant U.S. Attorneys who make these presentations to the grand jury. In this case, we know that there were concerns that were raised by the career lawyers in that office who did not believe that this was a case that they could bring to fruition. And so what we have here is two counts against the former FBI Director, an extraordinary day in American history, of course.
James famously won a massive civil fraud case against Trump last year, but the financial penalty imposed on him was tossed by a New York appeals court in August.
On September 20, Trump — mistakenly, according to reports — posted the following message, addressed to Attorney General Pam Bondi, on Truth Social:
Pam: I have reviewed over 30 statements and posts saying that, essentially, ‘same old story as last time, all talk, no action. Nothing is being done. What about Comey, Adam “Shifty” Schiff, Leticia?? They’re all guilty as hell, but nothing is going to be done.’ Then we almost put in a Democrat supported U.S. Attorney, in Virginia, with a really bad Republican past. A Woke RINO, who was never going to do his job. That’s why two of the worst Dem Senators PUSHED him so hard. He even lied to the media and said he quit, and that we had no case. No, I fired him, and there is a GREAT CASE, and many lawyers, and legal pundits, say so. Lindsey Halligan is a really good lawyer, and likes you, a lot. We can’t delay any longer, it’s killing our reputation and credibility. They impeached me twice, and indicted me (5 times!), OVER NOTHING. JUSTICE MUST BE SERVED, NOW!!! President DJT
