Balgarianovinite.com Justice Minister Nikolay Naydenov is calling on the current Supreme Judicial Council (SJC), whose term in office has expired, to stop making personnel changes, including closing and opening new permanent positions in the courts, the Ministry said in a press release on Wednesday.
The opinion was sent to acting Supreme Judicial Council Chair Boyan Magdalinchev. The reason is personnel changes added to the agenda for Thursday’s session of the SJC Plenum. At that time, Parliament would be debating on second reading draft amendments to the Judiciary Act, which explicitly exclude such personnel changes from the powers of a Supreme Judicial Council with an expired term in office. The current Council’s mandate expired in October 2022.
The amendments to the Judiciary Act envisage that the current SJC shall postpone until the next Council the adoption of decisions that directly affect the organization and functioning of the judicial system and its independence or have a lasting personnel or organizational effect. The SJC will not be able to appoint, promote and transfer magistrates, except in cases where junior judges, prosecutors and investigators must be appointed, as well as in the event of reinstatement or return to office, the Justice Ministry said.
“The adoption of hasty decisions by the SJC Plenum demonstrate gross disregard for the will of the National Assembly. Any personnel decision in this transitional period would generate public distrust,” warned Naydenov.
Earlier on Wednesday, the Minister said in an interview with bTV that he would present to the SJC letters received from administrative heads of courts against the personnel decisions of the Judges Chamber. Naydenov noted that a new composition of the SJC and the Inspectorate to the SJC is expected to be elected by mid-October, and a new Prosecutor General in February 2027. He also indicated that the new SJC will conduct an attestation of all heads of the judicial system appointed in the last three years.
