Balgarianovinite.com The Supreme Administrative Court (SAC) overturned a caretaker government decision revoking Bulgaria’s approved candidates for European prosecutor, the court said on Tuesday. The case was brought by three candidates approved under the previous procedure.
The court held that the challenged Council of Ministers act was unlawful on two grounds, SAC said. First, the factual circumstances did not correspond to the legal grounds invoked for exercising the cabinet’s powers. Second, the cumulative substantive requirements tied to the legal basis cited by the authority under Article 99, item 1, of the Administrative Procedure Code were not met.
The ruling may be appealed before a five-judge panel of SAC.
Andrey Gurov’s caretaker cabinet revoked Council of Ministers Decision No. 50 of January 21, 2026, which approved three Bulgarian candidates for European prosecutor: Dimitar Belichev, Mihaela Raydovska and Plamen Petkov. The same caretaker government decision launched a new selection procedure and set its deadlines and criteria.
In June, Justice Minister Nikolay Naydenov said in a written response to a parliamentary question that the indicative deadlines for selecting a new European prosecutor from Bulgaria, set in Council of Ministers Decision No. 267 of April 9, 2026, could not be met. The decision tasked Naydenov with organizing the candidate selection procedure.
The candidates nominated in the previous procedure appealed that decision. The procedure cannot resume until SAC issues a final ruling in the administrative case.
