Balgarianovinite.com Justice Minister Nikolay Naydenov said on Wednesday that he had submitted a reasoned request to the Prosecutors’ Chamber of the Supreme Judicial Council (SJC) to temporarily suspend Emine Rusinova, the acting administrative head of the Sofia City Prosecution Office, pending the outcome of disciplinary proceedings against her.
Naydenov made the statement in Veliko Tarnovo, North Central Bulgaria, where he attended the opening of a new detention facility and probation service office.
The minister said the Prosecutors’ Chamber of the SJC was meeting at the time to consider his request. As a party to the proceedings, he said it would not be appropriate to comment in advance on his expectations regarding the outcome.
According to Naydenov, Rusinova’s temporary suspension is necessary to ensure an objective and impartial examination of the facts in the disciplinary proceedings. He argued that the measure would help prevent any possible influence on prosecutors or on the work of the prosecution service she currently heads.
Commenting on judicial independence, the minister said judicial decisions should be taken independently. However, he argued that the current system provides greater independence to the heads of judicial institutions than to judges and prosecutors themselves, adding that this should be changed.
Asked whether the prosecution service was the “Achilles’ heel” of the judiciary, Naydenov said he did not share that assessment. In his view, the problems stem from structural deficiencies affecting various judicial institutions, which have led to the difficulties observed within the system.
