Constitutional Court Declares Parts of Lukoil Special Administrator Amendments Unconstitutional 2026

Balgarianovinite.com The Constitutional Court has declared unconstitutional several provisions of amendments concerning the special commercial administrator of Lukoil’s operations in Bulgaria, the Court said on Tuesday.
The case was initiated at the request of 51 MPs from the 51st National Assembly and was assigned to judge Orlin Kolev. All 12 constitutional judges took part in the proceedings and adopted the ruling unanimously.
The decision, accompanied by separate opinions from several judges, invalidates parts of the Administrative Regulation of Economic Activities Associated with Oil and Petroleum Products Act. Some of the annulled provisions concern the powers and activities of the special commercial administrator appointed to oversee Lukoil’s Bulgarian assets.
The Court rejected the request to declare unconstitutional the remaining contested provisions of the law and terminated proceedings concerning one specific paragraph.
According to the full ruling, the sponsors argued that the challenged provisions violate constitutional principles, including the rule of law, the separation of powers, the inviolability of private property, and the freedom of economic initiative. They also claimed that the legislative procedure had restricted constitutionally guaranteed rights of Members of Parliament.
Opposing legal opinions were submitted in the case. The Association of Bulgarian Fuel Traders, Producers, Importers and Carriers argued that the provisions were unconstitutional, while the legal expert Assoc. Prof. Ivan Tsvetanov defended their compliance with the Constitution.
The association maintained that extending the scope of the special commercial administrator mechanism to all economic operators, including small and medium-sized enterprises that do not control strategic or critical infrastructure, exposed them to an unjustifiably high risk of having their activities suspended without effective legal remedies.
In November 2025, Vazrazhdane invited parliamentary groups that had opposed the legislation to support its petition to the Constitutional Court. On November 7, Parliament adopted amendments related to the functions of the special administrator of Lukoil’s assets in Bulgaria in a single sitting. The bill was introduced by MPs from Movement for Rights and Freedoms – New Beginning, GERB-UDF, There Is Such a People, and BSP–United Left.
On November 14, the Council of Ministers appointed National Revenue Agency Executive Director Roumen Spetsov as special commercial administrator of Lukoil’s four companies in Bulgaria.
