The Senate confirmed Jay Clayton, 59, to serve as the director of national intelligence on July 28. The former chairman of the Securities and Exchange Commission was nominated by President Donald Trump in June, shortly after former DNI Tulsi Gabbard announced she would be stepping down from the role.

Democrats and some others questioned Clayton’s qualifications to be DNI, noting he lacked experience in intelligence work, having spent his career focused on financial matters.

Who is he?

Clayton served as chair of the SEC during Trump’s first term, from May 2017 to December 2020. He previously spent more than two decades as a Wall Street attorney at Sullivan & Cromwell LLP, where he co-headed the firm’s corporate and cybersecurity practices. During his legal career, he represented major financial players including Goldman Sachs during the 2008 financial crisis as well as hedge funds and corporate executives.

Following his time at the SEC, Clayton returned to Sullivan & Cromwell as a senior policy advisor and of counsel, remaining with the firm until April 2025, according to his financial disclosure report.

Trump nominated Clayton to be the U.S. attorney for the Southern District of New York (Manhattan) in April 2025. He took over the office after the interim U.S. attorney refused the Justice Department’s request to drop the corruption case against former New York City Mayor Eric Adams.

During Clayton’s tenure, the office began the prosecution of Nicolas Maduro, the former president of Venezuela who was captured by U.S. military forces and brought to Manhattan to face a cocaine importation conspiracy charge, among other counts. The office also oversaw portions of the document review process related to convicted sex offender Jeffrey Epstein, who was being prosecuted by the Southern District in 2019 before his death.

While Clayton’s DNI nomination was initially expected to draw bipartisan support, his repeated refusal during his confirmation hearing to admit that President Joe Biden was the legitimate winner of the 2020 election contributed to party-line votes from the Senate Intelligence Committee and the full Senate.

Follow the money

  • Clayton most recently made campaign contributions during the 2022 election cycle, when he donated between $1,000 and $2,000 to an assortment of Republican candidates, including Rep. Kevin McCarthy (R-Calif.) and Rep. Tom Kean Jr. (R-N.J.). He also donated $2,000 to a pair of Democrats: Sen. Chuck Schumer (N.Y.) and Rep. Jim Himes (Conn.).
  • According to his most recent financial disclosure report filed on June 19, Clayton earned over $3.5 million from Sullivan & Cromwell over the last year. Prior to his first appointment to the SEC, Clayton earned nearly $7 million annually from the firm.
  • In 2021, private equity firm Apollo Global Management appointed Clayton as its lead independent director after an independent investigation of Apollo founder Leon Black’s $158 million in payments to convicted sex offender Jeffrey Epstein. Clayton stepped down from that role upon his appointment as U.S. attorney in 2025.
  • While Clayton’s exact net worth is unknown, the figure could range from $50 million to $90 million according to the minimum and maximum values in his financial disclosure. His largest holding is a Goldman Sachs Financial Square Treasury Fund valued between $5 million and $25 million.
  • Clayton also reported more than $1 million in deferred compensation from American Express, in the form of Share Equivalent Units. He also received compensation and investment income connected to Apollo Global Management, CFGI LLC, Fireblocks Inc., and other financial firms where he held advisory or board roles after leaving the SEC.
  • As part of his ethics agreement, Clayton has agreed to divest certain assets and resign from outside positions in order to comply with federal regulations.

Why does it matter?

  • As director of national intelligence, Clayton oversees and coordinates the work of 18 U.S. intelligence agencies, advising the president on national security and coordinating intelligence collection.
  • Democrats have raised concerns about whether the Trump administration could abuse the powers of the intelligence community to sow false doubt about elections, and Clayton’s comments on election fraud have not stalled these fears. During a recent interview on CNBC, Clayton raised concerns about recent elections in California and suggested there was something wrong with the time it takes for the state to count ballots. He also would not say during his confirmation hearing whether voter fraud was a problem in U.S. elections.
  • Clayton’s office also drew scrutiny after issuing subpoenas to New York Times journalists over their reporting on security concerns surrounding the Air Force One airplane gifted to the Trump administration by Qatar. Clayton said the subpoenas were part of “an ongoing national security investigation” and that he had followed all proper procedures. Those subpoenas have since been withdrawn.

This article is part of a series examining the role political money has played in the careers of President Donald Trump’s nominees for executive branch positions.
