The Constitutional Court (CC) on Wednesday rejected a challenge to amendments giving Parliament the power to elect and dismiss the chair of the State Agency for National Security (SANS), the Court’s press office said on Wednesday.
The case was initiated at the request of 59 MPs from the 51st National Assembly. All twelve constitutional judges took part in the sitting.
In its reasoning, the Court said election by a parliamentary majority does not politicize SANS, whose governing law expressly requires political neutrality. Nor does it make the Chair dependent on the majority that elected them: the Chair exercises powers conferred by law, the Court said. It found that lawmakers may assign the power to select the Chair either to Parliament or to the President.
On September 17, 2025, Parliament introduced amendments under which the chairs of the State Intelligence Agency and State Agency Technical Operations are elected by the National Assembly on a proposal by the Council of Ministers and passed them on October 2, 2025. A similar decision was taken for the chair of SANS. Then-president Rumen Radev later vetoed the changes, but the parliamentary majority overrode the veto. In late October and early November, Vazrazhdane MPs filed a petition with the Constitutional Court seeking to have the amendments ruled unconstitutional.
