The National Council for Tripartite Cooperation failed to reach agreement on proposed changes to the Labour Code submitted by Vazrazhdane leader Kostadin Kostadinov and a group of MPs. The sponsors propose establishing a new public holiday, a Day of National Reconciliation, and removing the six-month limit on compensation paid to workers who have been unlawfully dismissed. Under the proposal, compensation would be paid for as long as court proceedings determining whether the dismissal was unlawful continue.
Labour and Social Policy Minister Natalia Efremova said the bill had passed first reading in Parliament’s Social Policy Committee, while the part concerning the new public holiday had been rejected by the majority. The Ministry opposes that proposal because of the additional costs it would impose on both the public and private sectors, she said.
On compensation for unlawful dismissal, Efremova noted that the maximum period had previously been four months and was later extended to six. She said the Civil Procedure Code provides for relatively short deadlines within which courts should rule on disputes over unlawful dismissal, broadly corresponding to the period for which employers are required to pay compensation.
“The purpose of this compensation is not to punish the employer. At this stage, we see no grounds for changing the period and consider the current provision sufficient,” Efremova said.
Asya Goneva of the Confederation of Independent Trade Unions in Bulgaria (CITUB) said public holidays should be established by the National Assembly rather than through the Labour Code. She said every such proposal should be carefully assessed in terms of its purpose, its impact on the public and private sectors and the intended effect. CITUB therefore does not support this part of the proposed changes. Goneva said the period of compensation for unlawfully dismissed workers should be adequate.
Valeri Apostolov of the Podkrepa Confederation of Labour also said national and public holidays should be determined by Parliament and that the Confederation did not support that part of the bill. Podkrepa, however, backed removing the time limit on compensation for unlawful dismissal, arguing that compensation should cover the duration of the court proceedings.
The employers’ organizations – the Bulgarian Industrial Capital Association, Bulgarian Industrial Association, Bulgarian Chamber of Commerce and Industry, and Confederation of Employers and Industrialists in Bulgaria – opposed both proposals. They argued that there was no justification for introducing another public holiday or for requiring employers to pay compensation for an indefinite period.
The social partners also discussed Monday a draft Ordinance on Salary Structure and Organization, including a new method for determining the minimum wage. They are yet to reach an agreement on that as the Podkrepa Labour Confederation does not approve the new method.
