Pharmaceutical Sector Organizations Propose Criminalizing Illegal Drug Production and Trade 2026

The Bulgarian Pharmaceutical Union (BPhU), the Association of Research-Based Pharmaceutical Manufacturers in Bulgaria, the Bulgarian Association for the Development of Parallel Trade in Medicines, the Bulgarian Association of Pharmaceutical Wholesalers and Retailers, and the Bulgarian Generic Pharmaceutical Association have proposed criminalizing the unauthorized production and placing on the market of medicinal products outside established legal channels by entities that are not licensed pharmaceutical wholesalers or retailers, the BPhU said.
The proposal is set out in a letter to the Prime Minister, the Chair of the National Assembly and the Ministers of Health and of Justice.
The organizations are calling for provisions to be added to the Penal Code to establish criminal liability for the unauthorized production of, and trade in, medicinal products, thereby limiting opportunities for the supply and use of dangerous products. They argue that the existing system of administrative penalties under the Medicinal Products in Human Medicine Act does not have the necessary deterrent effect.
In most cases involving online sales, the activities are carried out by unidentified individuals or legal entities that own no assets against which financial penalties can be enforced. The organizations say the full range of criminal investigation tools needs to be used, as the existing administrative procedures are not effective enough in identifying offenders and bringing them to justice.
The pharmaceutical organizations are calling on the executive and legislative authorities to set up a working group involving the signatory organizations and to submit to Parliament a bill amending and supplementing the Penal Code as soonas possible.
On October 9, Health Minister Katya Ivkova said more than 73 online platforms had been identified as offering medicines illegally, including over 30 websites mainly selling peptides. She also said there were gaps in the Penal Code.
