Caretaker Justice Minister Yankulov to Appeal Refusal to Name Acting Prosecutor General 2026

Balgarianovinite.com Caretaker Deputy Prime Minister and Caretaker Minister of Justice Andrey Yankulov said on Sunday he will appeal to the Supreme Administrative Court the Prosecutors Chamber of the Supreme Judicial Council’s refusal to consider his proposal for a new acting Prosecutor General. Borislav Sarafov now holds the post.
On March 11, 2026, the Prosecutors Chamber unanimously refused to consider Yankulov’s proposal to appoint a new acting Prosecutor General. The decision may be appealed to the Supreme Administrative Court within 14 days, or by March 25, 2026.
Yankulov said the ruling could in practice give Sarafov “an eternal temporary mandate.” He argued that this ran counter to the principles of the rule of law and said he would challenge the decision on that ground, as well as on procedural grounds, because the chamber had no right to refuse to consider his proposal.
Yankulov has been trying since February to force a decision on the acting prosecutor general issue. On February 20 he convened the Supreme Judicial Council plenum with a single agenda item, the appointment of a new acting prosecutor general, arguing that Borislav Sarafov’s continued tenure after July 21, 2025 was illegitimate and damaging to the rule of law. The plenum declined to consider the proposal on February 26 and referred it to the Prosecutors Chamber, which Yankulov urged again on March 11 to rule on the merits and designate a replacement. The Chamber unanimously refused to consider the proposal, leaving Sarafov in office.
Commenting on the Petrohan case, Yankulov said the problem lay in the institutional response in the first few days. He argued that pushing the case into the political arena, after public comments by Sarafov and political leaders, meant many people would never trust the institutions’ findings, however objective they might be.
On the case involving prosecutor Teodora Georgieva, Yankulov said it concerned disciplinary proceedings before the European Public Prosecutor’s Office, which “will apparently probably end at some point with a proposal for a disciplinary sanction.”
Disciplinary proceedings against European Prosecutor Teodora Georgieva were initiated by the European Public Prosecutor’s Office in September 2025, when she was temporarily suspended from office. On February 26, 2026, the EPPO said she had been found guilty of serious misconduct and would remain suspended pending the outcome of the proceedings. On March 18, European Chief Prosecutor Laura Kovesi said an internal panel had identified three misconducts and that the EPPO College had referred the case to the European Parliament, the Council of the EU and the European Commission in connection with the procedure for her dismissal.
