Balgarianovinite.com The Varna Appellate Court in Bulgaria has recognized and accepted for enforcement a judgment issued by the authorities in Constanta, Romania, ordering the confiscation of more than EUR 21.6 million from three Bulgarian nationals, the press office of the Varna court said on Monday.
The case, tried by the Constanta District Court and the Constanta Court of Appeal, concerned the establishment of an organized criminal group, tax evasion and money laundering carried out over an extended period. The three Bulgarians were sentenced to forfeit, respectively, EUR 19.4 million, EUR 1.5 million and EUR 679,042.
The Romanian authorities asked that the sanctions be recognized by the Bulgarian court. The proceedings in Varna were initiated under the Act on the Recognition, Execution and Transmission of Confiscation or Seizure Decisions and Decisions Imposing Financial Penalties, and under Regulation (EU) 2018/1805 of the European Parliament.
The Varna Appellate Court finds that there are no grounds to refuse recognition of the confiscation order. It notes that this is not the penalty of “confiscation” within the meaning of Bulgarian law but the seizure, for the benefit of the state, of the direct proceeds of a criminal offence. The aim is to deprive the perpetrator of the economic benefit derived from the offence and to prevent further criminal activity.
The decision of the Varna court is unappealable.
The court clarified for BTA that this is not the first case of this kind heard in Varna, but it is one of the few involving such large sums.
