Balgarianovinite.com The Commission on Protection of Competition (CPC) is expanding the scope of its powers in connection with the implementation of Regulation (EU) 2022/1925 – the so-called Digital Markets Act (DMA), CPC told the Bulgarian News Agency on Friday. This comes after the European Affairs Council tasked the institution with becoming the national competent authority in this field, and the necessary legislative amendments were made in November.
CPC noted that the regulation is applied centrally by the European Commission, but requires active involvement at national level in carrying out investigations, inspections and monitoring. In this context, CPC will support European investigations by assisting with on-site inspections, taking oral statements and providing information. According to the institution, this does not represent a new power, but an expansion of existing cooperation mechanisms.
According to CPC, the implementation of the activities laid down in the DMA will require close coordination with the European Commission, including through information exchange, operational meetings and participation in market investigations. On-site inspections, which may be carried out at the request of the European Commission, do not differ from those CPC carries out under national legislation. These include the ability to seize documents and records, including in electronic form, as well as taking oral statements from company representatives.
The institution points out that the necessary legislative amendments have already been made.
