The Bulgarian Retail Association urges the government to withdraw the draft methodology for determining the fair value of goods, in a position released on Tuesday.
The association believes that if the methodology is adopted, it will harm both businesses and consumers.
The methodology constitutes an unacceptable form of state intervention in the free market, under which pricing would no longer be governed by the natural balance between supply and demand, but instead by subjective administrative formulas. Such an approach goes beyond the constitutionally defined role of the state to ensure a transparent and competitive environment and turns regulatory authorities into direct participants in the supply chain, in violation of economic principles, the statement says.
According to the association, the proposed mechanism restricts businesses’ ability to pursue flexible pricing policies and offer commercial discounts. If a retailer temporarily reduces the price of a product as part of a promotion, any subsequent return to its usual price level could be interpreted by control authorities as an “unjustified increase.” This would indirectly prevent traditional promotional campaigns and discounts, which would directly affect end consumers, the BRA argues.
According to the association, artificially limiting prices below their actual market levels would discourage companies from importing or selling certain product categories. This would inevitably lead to products being withdrawn from store shelves and ultimately to shortages of key groups of goods.
In early August, the Economy Ministry published a draft methodology under which the prices of certain essential consumer goods that deviate by more than 10% from the so-called fair value would be subject to monitoring. The development of such a methodology followed the adoption of amendments to the Consumer Protection Act in June.
