Balgarianovinite.com The Judges Chamber of Bulgaria’s Supreme Judicial Council (SJC) has decided to request documents from the European Public Prosecutor’s Office (EPPO) concerning the disciplinary proceedings against former Bulgarian European Prosecutor Teodora Georgieva and the disciplinary penalty of “reprimand” imposed on her, as the Chamber prepares to rule on Georgieva’s request to be reinstated as a judge at the Sofia City Administrative Court.
Georgieva’s term as Bulgaria’s European Prosecutor expired on July 28. She has now applied to be reinstated in her former position, a right provided for under the country’s Judicial System Act.
The proposal to request the documents was made by Veronika Imova and supported by Boyan Magdalinchev, and all members of the Judges Chamber present at the meeting voted in favour.
Imova noted that the law contains a mandatory provision concerning reinstatement, but said this did not prevent the SJC from examining the issue of the moral and ethical qualities that a magistrate must possess. “It is well known to everyone that disciplinary proceedings were conducted by the EPPO and that Georgieva was given a disciplinary penalty,” Imova said, adding that Georgieva had been suspended for more than a year.
According to Imova, the case file from the EPPO should be requested so that the SJC Judges Chamber can assess the moral standing and integrity of the judge seeking reinstatement. Imova added that the legal grounds and factual circumstances that led to the disciplinary penalty should also be known. She recalled that there were negative assessments of Georgieva’s work as a European Prosecutor.
Magdalinchev backed Imova, saying that numerous questions have been raised in society and among members of the legal profession about the disciplinary proceedings against Georgieva. “I think we really need to think carefully before deciding on reinstatement whether the requirements for high moral standards and ethical conduct are met,” he said. According to Magdalinchev, the statutory provision on reinstatement is mandatory, but this does not mean that the magistrate should not meet the requirements of high professional standards and moral integrity.
The Judges Chamber ultimately voted to return the file concerning Georgieva’s reinstatement to the Commission for Attestation and Competitions, which will request the relevant documents on Georgieva from the EPPO. The Attestation Commission will then forward all the materials to the Commission for Professional Ethics to rule on any potential violation of the Code of Ethical Conduct for Bulgarian Judges and on whether Georgieva possesses the necessary moral qualities for reinstatement as a judge.
