
Balgarianovinite.com The European Court of Justice has issued rulings rejecting as inadmissible applications for a temporary suspension of the introduction of the euro in Bulgaria as a precautionary measure, according to a report on the website of the judicial institution published on Friday.
The applications were lodged in Case T‑653/25 R II, brought by anonymous applicants, represented by lawyers R. Chenalova and E. Kostova-Petkova, and in Case T‑654/25 R, brought by MEP Stanislav Stoyanov (Europe of Sovereign Nations/Vazrazhdane) and represented by the same lawyers. The cases are against acts of the Council of the European Union related to the introduction of the euro in Bulgaria.
According to the court, in both cases “in the application for granting a security, the applicant practically does not present arguments regarding the condition related to urgency, as well as the weighing of the relevant interests”, and “the application for granting a security does not contain a sufficiently precise and complete statement of the circumstances allowing the examination of the condition of urgency”.
According to settled case-law, urgency must be assessed in relation to the need to order interim measures to avoid the occurrence of serious and irreparable damage to the party requesting the interim measure. It is not necessary for the inevitability of the damage to be established with absolute certainty. It is sufficient that it be foreseeable with a sufficient degree of probability. However, the party relying on it remains obliged to prove the facts which are presumed to justify the possibility of serious and irreparable damage and to provide the judge hearing the application for interim measures with specific and precise evidence, supported by detailed documents, which prove its situation and enable the precise consequences to be assessed if the measures requested are not taken. The party requesting the interim measure is thus required to produce documents in support of the information which is capable of forming a true and accurate picture of the situation which, in its view, justifies the granting of those measures.
However, the court considered that in their application for the granting of a security interest, the applicants in both cases do not substantiate their position regarding the condition of urgency.
According to the application for granting security, the introduction of the euro in the economic and political context described in the Republic of Bulgaria will have serious and irreversible consequences for every Bulgarian citizen. It adds that the Bulgarian authorities preferred the adoption and introduction of the euro to take place under the so-called “big bang scenario”, which, given the state of the Bulgarian economy, in the conditions of a parliamentary crisis, external debt approaching the 60% mark, and inflation above the permissible limits. This, in turn, gives the case an urgent nature, since the introduction of the euro was an automatic process and there were only a few days left until the actual introduction of euro coins and banknotes into circulation, the magistrates noted.
The Court concluded that “this extremely general and terse statement does not provide any information as to the causes of the significant and irreparable harm which the applicants risk suffering and is not supported by any evidence as to the applicants’ current situation which could justify the granting of the interim measures requested”.
