An international conference marking the 35th anniversary of Bulgaria’s Constitutional Court took place in Sofia on Thursday. The theme of the conference was “The Role of Constitutional Courts in Guaranteeing the Rule of Law”. The event was attended by official representatives and delegations of constitutional courts from 31 countries in Europe, Asia and Africa. They discussed current issues related to the composition and independence of constitutional courts, the implementation of their decisions by other state bodies, as well as the practice of constitutional jurisdictions in times of crisis.
“The Constitutional Court should not be an institution of conformism, it is an institution of dissent, clothed in legal justification, which protects the long-term stability of the rule of law over short-term expediency”, said Constitutional Court President Pavlina Panova in her opening remarks.
Panova noted that the constitutional order, based on the principle of the rule of law, is often not destroyed abruptly, but eroded, when small injustices begin to be accepted as permissible, the principles that must be defended are interpreted in a compromising manner, and when non-compliance with the rules is justified. Panova also explained that the difference between legal order and chaos lies in the fact that in a state governed by the rule of law, disputes are resolved in dialogue and with the arguments of the Constitution and the law, and not by force.
According to her, in peaceful periods, institutions seem to function on a routine basis, and compliance with the Constitution seems to be a given, but the real test of the rule of law over arbitrariness comes when society is faced with serious crises, when passions prevail over reason, and when the different branches of power do not work in sync. “In these moments, guaranteeing the rule of law, including by independent and impartial judges, more than ever becomes a fortification against arbitrariness and chaos,” added Panova.
“For us, the decisions of the Constitutional Court are a compass, they are not an obstacle and I want to dispel all doubts – we will follow this compass and will not deviate from its direction, in this effort we learn from the mistakes made before, we would not like to repeat them”, said the Minister of Justice Nikolay Naydenov.
The minister said that the Constitutional Court does not always show and tell the authorities what they want to hear, but that is precisely why it is so valuable. He added that the Constitutional Court has more than once been an arbiter between the authorities in moments of political tension and constitutional trials, its decisions were the necessary balance and guarantor for the preservation of statehood.
