The Justice Ministry published proposed Judicial System Act amendments for public consultation, introducing new rules on magistrates’ secondment and competitive selection, the Ministry said on Friday.
The changes aim to strengthen competitive selection, curb indefinite secondments and provide more effective safeguards against undue influence.
The proposals seek to implement recommendations from the Organisation for Economic Co-operation and Development (OECD) and the European Commission.
They aim to strengthen the independence of judges, prosecutors and investigators through competitive recruitment and promotion, timely competitions and stricter selection criteria. Other measures would provide professional support and protection against undue influence.
Another priority is to restore secondment to its intended temporary and exceptional role. The draft would set a clear maximum total duration, counting cumulative periods of secondment to different judicial bodies.
Judges, prosecutors and investigators would be ineligible for secondment if their most recent performance appraisal rating was below “very good” or they had served in their current post for less than five years.
The amendments also seek to prevent holders of individual posts from becoming effectively insulated from accountability and reduce the risk of influence over other cases. They would provide an organizationally independent administration to support the prosecutor responsible for investigating crimes allegedly committed by the Prosecutor General or his deputy.
The government’s judicial reform programme also identifies limits on long-term secondments and greater transparency and integrity in personnel decisions as priorities.
In early June, Foreign Minister Velislava Petrova said Bulgaria had completed accession reviews in 18 of the OECD’s 25 working bodies.
