The Prosecutors’ Chamber of the Supreme Judicial Council (SJC) unanimously voted, with nine votes in favour, to propose Deputy Prosecutor General Magdalena Lazarova-Prodanova for acting Prosecutor General. The SJC Plenum is due to vote on her appointment on Thursday.
“If we broaden the range of criteria, we could be accused of a lack of impartiality or of favouring a particular candidate,” Kalina Chapkanova, a member of the Prosecutors’ Chamber, said at Wednesday’s meeting.
“If we adhere to a single criterion for selecting an acting officeholder and do not depart from it, as has been the SJC’s practice so far, we can ensure the impartiality of the procedure,” she said.
Chapkanova was commenting on a letter sent on Tuesday by Justice Minister Nikolay Naydenov, who called on the Chamber to give the SJC Plenum a genuine choice between candidates for acting Prosecutor General, with clearly stated positions and a vision for the prosecution service over the next six months. Naydenov urged the Chamber to broaden the pool of eligible candidates before the current acting Prosecutor General’s term expires on October 22, avoid using seniority as the decisive criterion, hear candidates on their intentions for the term, and ensure a transparent selection process to restore public trust in the institution.
On October 7, the Prosecutors’ Chamber decided to propose Lazarova-Prodanova for the position. She is currently Deputy Prosecutor General and next in line by seniority, which is why the post was offered to her.
This is the sixth procedure conducted by the current SJC to appoint an acting officeholder, whether for Prosecutor General or President of the Supreme Administrative Court or the Supreme Court of Cassation. In all six procedures, seniority has been the leading criterion and only one candidate has been proposed.
“I believe this is the main and leading criterion,” Prosecutors’ Chamber member Ognyan Damyanov said at Wednesday’s meeting.
He recalled that two weeks ago the SJC Plenum appointed an acting President of the Supreme Administrative Court without anyone raising objections.
Under the current procedure, any prosecutor from the Supreme Cassation Prosecutor’s Office, as well as any prosecutor elsewhere in the country who meets the requirements, could objectively be appointed acting Prosecutor General. However, in keeping with the established principle, only one nomination has been submitted to the Plenum, Damyanov said.
Had the two deputy prosecutors general been unable to take up the position, the Chamber would have considered other criteria. In the present circumstances, however, the principle of seniority could not be set aside, he added.
Damyanov also said he saw no point in holding hearings with candidates, since an acting Prosecutor General could be replaced at any time during the six-month term. The period was also too short for anyone to make significant changes, he said.
