A federal judge ordered the Trump administration to stop airing a $20 million taxpayer-funded advertising campaign promoting President Donald Trump on Sunday, even cutting off commercials scheduled to run through the night.
U.S. District Judge Jennifer Rochon issued a two-week temporary restraining order, barring the Department of Homeland Security (DHS) from spending or transferring any more money on the ads, which had been airing nationally over the last several weeks. Her order also required DHS to instruct contractor LMD Media to stop running them.
“Defendants are enjoined from using, disbursing, or transferring funds appropriated to the Department of Homeland Security to develop, create, disseminate, place, distribute, publish, or air the challenged advertisements,” Rochon wrote.
According to court filings seen by Politico, Customs and Border Protection (CBP) issued a $20 million purchase order to LMD Media on Sept. 20 using money made available through the Working Families Tax Cut Act for activities “commemorating efforts and events related to border security.” Around $19 million had already been committed to the national TV ad buy.
The commercials aired across numerous networks, including Fox, CNN, MS NOW, CBS, ABC, Newsmax, and ESPN, with the campaign drawing bipartisan criticism over its overtly political tone and government financing.
Common Cause and other plaintiffs sued to stop the campaign, arguing the administration was improperly using public money for political propaganda ahead of the November midterm elections. The Democratic National Committee (DNC) filed a separate challenge.
The administration reportedly tried to head off the emergency order over the weekend by telling the court there were “no plans” to continue the ads after Sunday, but plaintiffs objected, accusing the government of trying to “run out the clock.”
Trump had already announced that future versions of the ads would instead be paid for by his political operation, MAGA Inc., after criticism of the taxpayer-funded campaign. Common Cause has separately challenged that arrangement before the Federal Election Commission.
