The Department of Justice’s firing of former federal prosecutor Maurene Comey last year was ruled to be illegal by a federal judge on Monday. The daughter of Trump nemesis and former FBI head James Comey can now be reinstated — with back pay.
Comey worked in the Southern District Court of New York for nearly a decade, and prosecuted both Jeffrey Epstein and Ghislaine Maxwell before she was abruptly fired by then-Attorney General Pam Bondi in August 2025.
It was the same Southern District Court where it was ruled on Monday that the Trump administration’s move to fire Comey under Article II of the Constitution was “wrong” after Comey sued for wrongful termination.
“It is also without merit,” the ruling states. “Indeed, to accept Defendants’ argument would be to unsettle the very equilibrium established by this Nation’s constitutional system.”
“The Court grants Comey retroactive reinstatement and backpay effective from the date of her termination through December 20, 2025, which will make her whole for the period during which she was unlawfully terminated,” the ruling said.
The order was signed by Judge Jesse M. Furman, who was appointed to the bench by then-President Barack Obama in 2012.
After Comey was fired, she did not go quietly, as she penned a scathing exit message that was circulated to colleagues. In it, she warned that “fear is the tool of a tyrant,” in what appeared to be a veiled hit at both President Donald Trump and Bondi.
“If a career prosecutor can be fired without reason, fear may seep into the decisions of those who remain,” she wrote in the message obtained by Politico. “Do not let that happen.”
“We have entered a new phase where ‘without fear’ may be the challenge,” she added, referencing the office’s longtime motto of impartiality. “Let this moment fuel the fire that already burns at the heart of this place… Of commitment to seek justice for victims. Of dedication to truth above all else.”
