Justice Minister Calls on Supreme Judicial Council Prosecutors’ Chamber to Propose More Than One Acting Prosecutor General 2026

Justice Minister Nikolay Naydenov has sent a letter to the Prosecutors’ Chamber of the Supreme Judicial Council (SJC), calling on it to offer the SJC Plenum with a genuine choice between candidates who have clearly stated positions and a vision for the prosecution service for the next six-month period, the Justice Ministry said here Tuesday.
Naydenov insists that, before the current acting Prosecutor General’s term expires on October 22, the pool of eligible candidates should be expanded, seniority should not be used as the decisive criterion, and candidates should be heard on their plans for the period in which they would serve. He also called for a visible and transparent selection process to restore public trust in the institution.
Naydenov said the Prosecutors’ Chamber is the body legally and institutionally responsible for ensuring that the full range of candidates is considered before the SJC Plenum makes its decision. For this reason, and given the ongoing procedure for electing SJC members, the Minister said he would not exercise his right to nominate an acting head of the prosecution service at this stage. This, he said, would avoid any doubts about any interference by the executive in the judiciary’s work.
Another reason cited in the letter was that he had not received personnel records for those who had agreed to take on the role of acting Prosecutor General. According to information provided by the prosecution service, two heads of departments at the Supreme Cassation Prosecutor’s Office had agreed to serve in the post for the next six months. Their names have been referred to the Prosecutors’ Chamber for consideration as it assesses potential nominees.
The Justice Minister noted that since June 2023, the prosecution service has routinely been headed by acting officeholders, although the Judiciary Act envisages this as an exceptional arrangement. Naydenov also recalled that previous selection procedures involving a single candidate had not produced positive outcomes for the prosecution service.
The Minister expects the new acting Prosecutor General to demonstrate “real action to restore trust in the institution” within a short and reasonable period after taking office, including steps to address work organization and identified problems, such as those at the Sofia City Prosecutor’s Office.
On October 7, the Prosecutors’ Chamber of the SJC decided to propose prosecutor Magdalena Lazarova-Prodanova for the position of acting Prosecutor General. If she agrees, the proposal will be put to a vote by the SJC Plenum. She currently serves as a deputy prosecutor general and is next in seniority, which is why the post was offered to her.
