Justice Minister to Consider Appeal Against Acting Prosecutor General’s Selection 2026

Justice Minister Nikolay Naydenov said on Thursday he would assess whether he had grounds to appeal Deputy Prosecutor General Magdalena Lazarova-Prodanova’s selection as acting Prosecutor General and whether an appeal would be appropriate.
He spoke to reporters after the Plenum of the Supreme Judicial Council (SJC) selected Lazarova-Prodanova.
Naydenov said the Prosecutors Chamber’s nomination of only one candidate continued a longstanding tradition within the prosecution service.
Asked why he had not nominated anyone, Naydenov said he had not felt sufficiently confident to propose a suitable candidate because he had not received personnel records for Supreme Cassation Prosecution Office prosecutors eligible to consent to taking part in the selection procedures.
Earlier on Thursday, the SJC Plenum selected Lazarova-Prodanova as acting Prosecutor General by 17 votes to two. The decision can be appealed within 14 days. The Judicial System Act limits any individual’s service as acting President of the Supreme Administrative Court, acting President of the Supreme Court of Cassation or acting Prosecutor General to six months. Lazarova-Prodanova, currently a deputy prosecutor general, was nominated because she is next in seniority after current acting Prosecutor General Vanya Stefanova, whose term expires on October 22.
In an October 13 letter, Naydenov urged a broader choice of candidates, hearings on their plans for the next six months and a transparent selection process, with seniority no longer the decisive criterion. The Justice Ministry said two department heads at the Supreme Cassation Prosecution Office had agreed to serve as acting Prosecutor General and their names had been sent to the Chamber.
The Chamber endorsed her nomination unanimously on October 14, with nine votes in favour. Chamber member Ognyan Damyanov said seniority had been the leading criterion in all six procedures conducted by the current SJC to appoint acting heads of the prosecution service or the two supreme courts, with one candidate proposed each time.
The six-month ceiling dates from amendments effective January 21, 2025. In a decision on April 7, 2026, the Constitutional Court confirmed the time limit, explaining that its purpose was to prevent the same person from performing those functions indefinitely.
