Justice Minister to Take Defensive Actions against Former Prosecutor General Sarafov in Accordance with Law 2026

In a statement on Thursday, Justice Minister Nikolay Naydenov said he would take defensive steps against the actions of former prosecutor general Borislav Sarafov in accordance with the law, without using the media for that purpose. He was referring to an open letter from Sarafov – currently an investigator with the National Investigation Service – to Prime Minister Rumen Radev, the members of the Supreme Judicial Council (SJC), Interior Minister Ivan Demerdzhiev, and the Chairman of the State Agency for National Security, Plamen Tonchev.
In the letter, Sarafov asserts that Minister Naydenov “has been conducting a sort of casting process for candidates for the SJC professional quota in recent weeks, organizing meetings with them both in his office and in the private office of the Ratola company in Sofia’s Lozenets borough.”
In his statement, Minister Naydenov asserted that he would not allow this dispute to divert attention from what is essential: the election of the new SJC members, in which candidates are evaluated based on professionalism and integrity. “In one of my first public statements after taking office as Minister of Justice, I called on Mr. Borislav Sarafov to show sufficient honour and withdraw from the system on his own, noting that I would commend him if that happened. Mr. Sarafov did not deserve such commendation,” Naydenov stated.
“As Minister of Justice, I receive judges in my office at the Ministry. This is part of my job, and I will continue to do so. Among them were some who claimed they had been subjected to pressure. No SJC candidate has received any promises, commitments, or requests for loyalty from me, either at the Ministry or elsewhere,” Naydenov noted, emphasizing that he had not sought support for the election of a prosecutor general, much less for himself.
“The company mentioned in the letter is engaged in the sale and servicing of automobiles, as well as their insurance; I visited their office for personal reasons. No meetings with candidates for the SJC took place there. If Mr. Sarafov has evidence of a crime, as an investigator he is well aware of the proper procedure for reporting it. That procedure does not involve the media,” Naydenov commented.
“The typical tactic used by those who fabricate smear cases is to link actual events to claims they have fabricated, with the aim of lending credibility to the overall narrative. The fact that I visited the office of a car dealership and service centre, where I have my personal car serviced and pay my insurance premiums, as well as the fact that I received magistrates in my office at the Ministry of Justice, have been conveniently woven into a smear campaign. I do not know whether this is an expression of Mr. Sarafov’s irritation that, in my official capacity, I will appeal the refusal to initiate disciplinary proceedings against him, or whether something larger lies behind it – namely, that by creating an artificial scandal, they are seeking to derail the upcoming election of a new SJC and keep the status quo in power,” Naydenov argued.
“In contrast to his previous actions, Mr. Sarafov appears to have reacted like a true investigator – according to his own understanding – and has used the tools at his disposal to monitor and control my meetings both within and outside the Ministry. The problem here is not a personal one, but an institutional one, and as such, it must be resolved,” said the Justice Minister.
