Supreme Administrative Court, Supreme Bar Council Lose Constitutional Cases 2026

Balgarianovinite.com Adjudicating Constitutional Case No. 6 of 2026, Bulgaria’s Constitutional Court on Thursday declined a petition submitted by the Supreme Administrative Court (SAC) to declare unconstitutional a provision of the Measures Against Money Laundering Act which obliges the Supreme Bar Council (SBC) to adopt uniform internal rules on money-laundering and terrorist-financing control and prevention, to be applied by the members of the bar associations.
The SAC argued that the SBC can issue statutory instruments of secondary legislation only if empowered to do so by The Bar Act. “The constitutional status of the Bar is no grounds to limit the exclusive powers of the National Assembly, acting at its discretion and without violating any principles of the basic law, to provide for an obligation of the Supreme Bar Council to adopt uniform internal rules. The circumstance that this obligation is provided for by a law other than The Bar Act does not make it constitutionally intolerable,” the Constitutional Court ruled.
In Constitutional Case No. 5 of 2026, which was also decided on Thursday, the Constitutional Court declined a petition by the SBC to find unconstitutional a provision of the Code of Civil Procedure which makes civil cases with a cost of action not exceeding BGN 5,000 and commercial cases with a cost of action not exceeding BGN 20,000 ineligible for a cassation appellate review.
“Setting the admissibility of a cassation appellate review according to the monetary appraisal of the subject matter and according to the cause of action and the nature of the case, combined with the selection of the cases, is not unconstitutional because a cassation appellate review is intended to ensure a legally conforming adjudication of cases within a reasonable period of time rather than to ensure the access of all or of the predominant type and number of cases to the court of cassation review instance,” the Constitutional Court concluded.
The 12-member Court adopted both decisions by 10 votes in favour. They were signed with a dissenting opinion by Judge Sonya Yankulova. Judge Nevin Feti was absent from the session.
