Balgarianovinite.com In a Facebook post published on Saturday, caretaker Deputy Prime Minister and Minister of Justice Andrey Yankulov commented on the ongoing trial at the Court of Justice of the European Union (CJEU) that involves caretaker Prime Minister Andrey Gurov. Yankulov said that there is no legal issue with the appointment of Gurov as caretaker Prime Minister, nor can there be one, regardless of how the dispute is ultimately resolved by a final court ruling, because at the time of Gurov’s appointment, he was deputy governor of the Bulgarian National Bank, i.e. he was eligible to be appointed to the position of prime minister.
Yankulov said that, due to alleged incompatibility, “We are witnessing a comedy sketch in which political leaders are attempting to interpret a somewhat complex legal text.” The Minister continued: “The claims that the Advocate General issued an opinion on the legality of Gurov’s removal and that this implied his illegitimacy as prime minister are completely divorced from reality.” Yankulov added that Parliament established this fact by accepting that Gurov’s powers as BNB Deputy Governor were terminated upon Gurov’s appointment as caretaker prime minister, without the need to vote on his resignation.
The Justice Minister proposed that a more interesting aspect of the case is how and by which state body the alleged incompatibility, which served as the basis for the BNB’s Governing Council to remove Gurov, was established. He added that the BNB’s decision to temporarily remove Gurov was made quickly, without giving him an opportunity to defend himself.
Regarding the Advocate General’s opinion, Yankulov noted that it raises the question of whether holding a minimal stake in a limited liability company constitutes grounds for incompatibility under Bulgaria’s legislation.
Yankulov stated that the incompatibility in question, which served as the basis for the BNB’s decision, was identified by the now-defunct Counter-Corruption Commission, which he described as a body that generated “noise and disappointment”, since in 2024, it applied that law selectively.
Gurov’s incompatibility was based on his ownership of a 2% stake in a company and his membership in two non-profit association, however, according to Gurov’s defence, he took the necessary steps in a timely manner to terminate his involvement in them, Yankulov added.
An Advocate General at the CJEU issued an opinion on the case regarding the requirements for the management of the BNB earlier this month.
