The Department of Justice is looking into whether major television networks violated antitrust laws when they suspended President Donald Trump’s press pool coverage, The New York Times reported Saturday.

“Officials from the Justice Department contacted networks on Friday and demanded communications and materials related to the White House TV pool,” sources told the Times.  “The pool is a longstanding system where the networks share the responsibility of providing footage of the president and distributing it to other news outlets.”

Shortly after Trump banned CNN, MS NOW and Politico from covering the White House last month over “fake news” allegations, the five networks that make up the White House press pool united to effectively suspend any coverage of Trump as pushback to his anti-First Amendment actions.

On Sept. 21, White House TV pool chair and Fox News Washington Bureau Chief Bryan Boughton wrote to pool subscribers, “Effective today, the TV pool will not be covering events designated as pool coverage of the President. This follows the White House’s position preventing CNN from fulfilling its assigned pool duties. There will be no replacement pool put in place.”

“The inquiry by the Justice Department is a profound escalation of the Trump administration’s ongoing battles with the White House press corps,” the Times reported. “It also follows a pattern of the Trump administration using the levers of government against its perceived foes in the media.”

Justice Department spokeswoman Emily Covington said in a statement, “Members of the television press pool have proudly boycotted covering White House events. Group boycotts among commercial competitors can violate the Sherman Act.”

“The Antitrust Division is simply investigating to determine whether these news organizations have violated the antitrust laws,” Covington said.

CNN, MS NOW and Politico are currently suing the Trump administration over First Amendment principles.  A federal judge issued a temporary block on the ban, which expires on Tuesday.

Attorneys for the networks have not yet responded to reports of the DOJ investigation.
