Deputy Justice Minister Irena Borisova and Council of Europe (CoE) Director of Human Rights Clare Ovey discussed the implementation of European Court of Human Rights judgments on Wednesday.
The meeting at the Justice Ministry focused on the rule of law, the effectiveness and independence of criminal investigations involving the Prosecutor General, and progress on judicial reform.
Ovey is in Sofia on a CoE mission focused on the implementation of specific judgments. The talks with Justice Ministry representatives concerned the S.Z., Kolevi and Miroslava Todorova groups of cases, the Ministry said.
The meeting covered measures in the government’s programme for the justice sector, including efforts to counter networks of “informal influence” within the judiciary, plans for additional detailed rules governing the election of the presidents of the two supreme courts and the Prosecutor General, and provisions to ensure their accountability to the public.
“The expertise of the Council of Europe is very important to us, and the issues raised by the group of cases we are discussing have long been challenges for the country. Several successive governments have sought solutions. We have opted for continuity, preserving what works and building on it,” Borisova said. “The reform is not yet complete, but all the measures are interconnected to ensure the rule of law,” she added.
Ovey said enormous progress had been made and that she was impressed reform was continuing despite frequent changes of government.
The CoE representatives were briefed on the ongoing process to elect a new Supreme Judicial Council and proposed new rules on competitive selection and performance appraisals for magistrates, in line with requirements set by the Organisation for Economic Co-operation and Development and the European Commission.
