Bulgarian authorities have been notified that North Macedonia is seeking the arrest and extradition of Iva Mihaylova, a dual Bulgarian and North Macedonian national, the Bulgarian Interior Ministry said on Wednesday.
The Ministry said that at 7:38 p.m. on October 13, its International Operational Cooperation Directorate received a message from INTERPOL Skopje requesting an international search for Mihaylova with a view to her arrest and extradition.
Mihaylova is standing trial for violating road traffic regulations, and a court in Kocani has issued a warrant for her arrest. No INTERPOL Red Notice has been issued for her, the Ministry said.
Bulgarian authorities have not taken steps to establish Mihaylova’s whereabouts in Bulgaria, according to the statement.
The Ministry cited Article 25(4) of the Bulgarian Constitution, which provides that Bulgarian citizens cannot be surrendered to another state or an international court for criminal prosecution unless this is permitted under an international treaty ratified, promulgated and in force for Bulgaria.
It also referred to Article 6(1)(a) of the European Convention on Extradition, under which contracting states have the right to refuse to extradite their own nationals.
The 23-year-old Mihaylova is facing trial in Kocani over a road accident in early October 2025 that resulted in a fatality and left several other people injured, including Mihaylova herself.
Following the accident, both her Bulgarian and North Macedonian passports were confiscated, and she was prohibited from leaving Kocani.
The travel restriction prevented Mihaylova from receiving medical treatment which, according to medical assessments by a hospital in Skopje, was unavailable in North Macedonia but could be provided in Bulgaria, Turkiye or Israel.
The Kocani court refused to return her documents, and the Court of Appeal in Shtip upheld that decision.
On the morning of October 12, it emerged that Mihaylova was in Bulgaria. She and her Bulgarian lawyer, Nikolay Dimitrov, told Bulgarian media that they had entered the country through a border crossing and that Mihaylova had presented identity cards issued by both Bulgaria and North Macedonia.
However, according to North Macedonia’s Interior Ministry, her departure from the country was not recorded in the Border Police system.
