Balgarianovinite.com Speaking to reporters ahead of Thursday’s meeting of the Supreme Judicial Council, Justice Minister Nikolay Naydenov said: “It is clear that the status quo in the Judiciary continues to operate in the all-too-familiar way.” He was commenting on Wednesday’s unanimous vote by the SJC Prosecutors’ Chamber against his request to temporarily suspend prosecutor Emilia Rusinova as head of the Sofia City Prosecution Office pending disciplinary proceedings against her.
“I did not expect any other outcome, although I did hope they would show some common sense,” Naydenov added.
He explained that his option is to file a legal appeal, but first he wants to review the reasoning for the decision – which is not yet available – and will then say with certainty whether he will appeal. “Some information has leaked suggesting that the reasoning is related to the fact that there is no evidence that Emilia Rusinova could exert influence over the prosecutors at the Sofia City Prosecution Office,” Naydenov said. According to him, if that is the case, the grounds are not valid.
“It is as if your superiors have no right to influence your work,” Naydenov added to reporters. “The Sofia City Prosecution Office has become a sort of hub for sensitive investigations, and I suspect that this attitude toward Emilia Rusinova is linked precisely to one of them. I can surmise that one of these investigations is related to the so-called Hemusgate, regarding which the situation is more than concerning given the long period during which no action has been taken,” Naydenov commented.
After part of the investigations in this case were made public, the case did not proceed in any way, he went on to say. “Above all, if you trace the career progression of the prosecutors who worked on the case after the original prosecutors were removed, you will see that all of them were promoted immediately after the case was shelved,” the Minister argued. He added that, since the cases are with the prosecution service, it is frivolous to claim that a member of the Executive could exert any influence over them.
In April, caretaker Justice Minister Andrey Yankulov submitted a proposal to initiate disciplinary proceedings against Rusinova. The proposal was based on allegations that she had crossed Bulgaria’s border twice with former investigator Petyo Petrov, known by the nickname “The Euro”, and Kristian Hristov, at a time when the Eight Dwarfs high-profile corruption case against Petrov had already become public. By then, information had also emerged that inquiries had been launched to establish the facts surrounding the case, Yankulov said at the time. In a written statement sent to the media at the time, Rusinova denied the allegations.
