CNN, MS NOW, and Politico have teamed up to sue President Donald Trump over his new press ban against the three outlets, with the outlets arguing in a Monday morning filing it “brazenly discriminates based on editorial viewpoint” and has already caused “irreparable harm” to their organizations.
The complaint for declaratory and injunctive relief was filed in U.S. District Court in Washington, D.C. Beyond the three outlets being named, three White House reporters from each are listed as plaintiffs: MS NOW reporter Akayla Gardner, Politico reporter Cheyenne Haslett, and CNN’s Betsy Klein.
“The exclusion of CNN’s, MS NOW’s, and Politico’s reporters from the White House accordingly inflicts irreparable harm to these news organizations,” the lawsuit said. “The organizations, whose very purpose is to report national news, depend on individual reporters to gather information firsthand at the White House. As a result of the ban, they have lost the ability to perform essential newsgathering at the seat of the Executive Branch, where critically important newsworthy events occur every day.”
Trump’s “unconstitutional” ban should be overturned for three reasons, according to the filing, with the first being it violates the Due Process Clause, since Trump failed to give the outlets the “bare minimum” advance notice.
“Second, the ban retaliates against protected newsgathering and speech in violation of the First Amendment. The President announced that the ban is a punishment for the content of past news coverage from CNN, MS NOW, and POLITICO,” the lawsuit said, before adding, “The President has made no attempt to hide that his ban punishes protected speech, stating expressly that he decided to ban CNN, MS NOW, and Politico for their ‘cumulative’ coverage over the past two years of him and his administration—coverage that in his view is ‘fake,’ ‘sick,’ ‘purposely negative,’ ‘one-sided,’ and ‘never good.’”
The third reason is the ban “violates the First Amendment for the separate and independent reason that it bars CNN, MS NOW, and Politico from a nonpublic forum for unlawful reasons.”
Their lawsuit added:
The D.C. Circuit has held that the “White House Press Area” is a nonpublic forum. Government restrictions on access to a nonpublic forum may not discriminate based on viewpoint and must be reasonable in light of the purposes of the forum. The President’s ban brazenly discriminates based on editorial viewpoint; it expressly excludes CNN, MS NOW, and POLITICO based on the content of their coverage.
Monday’s filing comes three days after Trump announced the ban. It also coincided with the White House expanding the press ban and yanking CNN off its scheduled TV pool assignment on Monday. Trump defended the ban, saying the free press is “something which I cherish” — but he viewed the outlets as nothing more than “FAKE NEWS” peddlers.
“It is instituting an assault on the FAKE NEWS, something that has grown like Cancer in our beloved United States of America,” Trump posted on Truth Social. “It is corrupt, purposeful, pervasive, fully coordinated, and totally out of control. It is a threat to our National Security, and must be stopped, NOW! Thank you for your attention to this matter.”
Beyond Trump, the lawsuit named White House Communications Director Steven Cheung, Secret Service Director Sean Curran, and White House Chief of Staff Susie Wiles. It urged the court to “immediately” overturn the ban.
